Terms and Conditions

1. Who we are
Hypha is a business name of a partnership between Jude Lewis and Paul Burrows, of 1108 3/2 Argyle Street, Glasgow G3 8TD. In these terms "we" and "us" mean that partnership. Contact us at hello@growhypha.com.
These terms cover your use of the Hypha app and its companion website (together, "the Service"). By creating an account or using the Service you agree to them. If you do not agree, do not use the Service. Our Privacy Policy explains how we handle your data and forms part of this agreement. If you use the app on an Apple or Android device, that store's terms also apply.
2. Your account
You need an account to use most of the Service. Give accurate information, keep your password secure, and tell us if someone else gets access. You are responsible for activity on your account. You must be at least 16 years old, or older if the age of digital consent where you live is higher.
You can delete your account at any time under Settings → Security and privacy → Delete account. Deletion is permanent and removes your account and the content you have posted, except records we must keep by law (orders, payments, tax), records of moderation and enforcement, and copies in backups until those are overwritten.
3. Your content and acceptable use
You keep ownership of anything you post. By posting, you give us a non-exclusive, worldwide, royalty-free licence to host, store and display that content within the Service so the app can work. You confirm you have the right to post it, and you agree to cover our reasonable losses if someone brings a claim against us over content you posted in breach of these terms.
There is no tolerance for objectionable content or abusive behaviour. You must not post content that is unlawful, threatening, harassing, hateful, pornographic or deliberately misleading; that infringes someone else's rights; that promotes or assists the cultivation, extraction or supply of any controlled species or substance, including psilocybin-containing mushrooms; that urges anyone to eat fungi not identified by a qualified expert; or that we reasonably consider harmful to other members. You must not spam, impersonate others, scrape the Service, or attempt to disrupt it.
4. Moderation
We filter content on upload and actively moderate. You can report any post, comment or member from inside the app, and block members you do not want to hear from. We aim to review reports and remove content that breaks these rules within 24 hours, and may suspend or permanently remove the accounts responsible. If we act against you we will tell you why and you can appeal to hello@growhypha.com. If we close your account for breach, you are not entitled to a refund.
5. Identification, AI and foraging — please read
The Service does not tell you whether anything is safe to eat.
The AI photo feature gives an automated best guess on cultivation problems and possible species. It is informational only, it is often wrong, and it is not expert identification or safety advice. Anything other members tell you is their opinion and we do not verify it.
Never eat, taste or forage anything on the strength of the app, a course, a coaching session, or another member. Many fungi are seriously poisonous and some are fatal, and poisonous species can closely resemble edible ones.
Map locations are for interest only and may be inaccurate, out of date, or on private or protected land. You are responsible for landowner permission, local law, and protected species and sites.
You use these features at your own risk, to the fullest extent the law allows. Nothing here limits our liability for death or personal injury caused by our negligence.
6. Memberships
Membership includes access to our cultivation courses for as long as your membership is active. Course content is for your own use and must not be copied, shared or resold.
Memberships bought inside the iOS or Android app are billed through your App Store or Google Play account as auto-renewing subscriptions. The price and billing period are shown before you buy. Your subscription renews automatically unless you cancel at least 24 hours before the end of the current period, in your store subscription settings. Deleting the app or your Hypha account does not cancel a store subscription. Refunds for store purchases are handled by Apple or Google.
Memberships bought at growhypha.com are processed by Shopify Payments and renew until you cancel, which you can do at any time in the app under Settings. Cancellation takes effect at the end of the period you have paid for. We will give you at least 30 days' notice before any price change applies to you.
Before any membership renews, we will email you in good time with the date it renews, what you will be charged and how to cancel. For annual memberships we will send that reminder at least 30 days ahead.
You normally have 14 days to cancel a website purchase. Because membership gives immediate access to digital content, at checkout you agree that we can start straight away and acknowledge that you lose that right once you access the content. If you have accessed nothing, email hello@growhypha.com within 14 days for a full refund.
Grow kits include one month of membership, redeemed with the code supplied. It is available to new members only, limited to one per customer, and converts to a paid monthly membership at the price shown when you redeem it unless you cancel before the free month ends. We will email you at least seven days before the free month ends, telling you the date it converts, what you will be charged and how to stop it. You can cancel at any time in the app under Settings, or in your App Store or Google Play subscription settings if you subscribed there. The free month has no cash value.
Annual memberships include one Big Batch grow kit, claimed at growhypha.com and shipped to addresses in the UK, USA, Australia and the European Union. If you cancel an annual membership within the 14-day cancellation period and we refund you, we may deduct the retail price of the kit from your refund. You do not need to send the kit back.
7. Shop
Goods are described on their product pages. Payments on growhypha.com are processed by Shopify Payments, and payments inside the Hypha app are handled by Apple, Google or Stripe; we never see your full card details. We ship to the UK, USA, Australia and the European Union within 30 days — delivery costs and times are in our Shipping Policy, and EU orders may attract import charges on arrival.
If your kit does not fruit, our 60-day grow guarantee covers you and there is nothing to send back. If you change your mind, you can return an unused item in its original packaging within 30 days. If you are a consumer you also have a legal right to cancel within 14 days of delivery, which does not depend on the packaging. All of this is set out in our Refund and Returns Policy. Your statutory rights, including for faulty goods, are not affected.
8. The Service and our liability
The Service is provided "as is": we do not promise it will be uninterrupted, secure or error-free, that its content is accurate, or that features will not change or be withdrawn.
To the fullest extent the law allows, we are not liable for indirect or consequential loss, lost profit, lost data, or a failed grow, and our total liability to you in any 12-month period is limited to the greater of what you paid us in that period and £100. Nothing limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot legally be limited. Your statutory rights are not affected.
9. Changes and ending
We may suspend or close accounts that break these terms. We may update these terms; if a change is material we will tell you in the app at least 30 days before it takes effect, and continuing to use the Service means you accept it.
We may transfer our rights and obligations under these terms to another business, including to a company we incorporate to run the Service, and will tell you in the app if we do. You may not transfer yours.
10. Apple
These terms are between you and us, not Apple or Google. Apple has no obligation to provide support for the app. If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price; Apple has no other warranty obligation and is not responsible for any intellectual property, product liability or consumer protection claim relating to the app. You confirm you are not in a country subject to a US Government embargo and not on any US Government prohibited party list. Apple and its subsidiaries may enforce these terms against you as third-party beneficiaries.
11. General
If any part of these terms is unenforceable, the rest still applies. Nobody other than you and us can enforce these terms, except Apple under section 10.
These terms are governed by Scots law and the Scottish courts have jurisdiction, though if you are a consumer elsewhere in the UK or the EU you keep the protection of your own country's mandatory laws and can sue locally. Please email hello@growhypha.com first if something has gone wrong.
